DEED RESTRICTIONS

When you bought your home, regardless of how long ago, you should have received a set of deed restrictions at closing. These deed restrictions state what you can do and can't do with the property you own in Sun City, and are enforceable by law. If you have never lived under such rules before you moved to Sun City, or moved here many years ago, look for your copy of the restrictions that apply to your individual property. Because of an increasing number of violations, which can be costly to you to correct, HOA will support action by members against residents who aren't in conformance.

Title companies with offices in Sun City have agreed to furnish copies of restrictions. If you didn't get one, call your title company. HOA has only file copies, but for a small fee can provide you with a copy if you know your deed restriction unit number.

Before you take any action involving your property, read the actual text, including all revisions, of deed restrictions that apply. The term "property" refers to residences and the yards around them. To take any action not permitted by deed restrictions, but which you feel you can justify, submit a request for variance to Maricopa County Department of Planning & Infrastructure, 301 W. Jefferson Street, Phoenix, AZ 85003. The fee is $100 minimum. Requests are forwarded to HOA for review and comment. Although the County Board of Adjustment decides whether to approve, HOA's recommendation is usually accepted.

RULES FOR SUN CITY RESIDENTS

The rules under which all of us in Sun City must live are embodied in the Federal Fair Housing Amendments Act of 1989, Maricopa County's Age Restricted Zoning Ordinance, and your local deed restrictions.

Under the Fair Housing Amendments Act and its revisions, at least one person living in a residence must be no younger than 55 years old.

Under the Restricted Zoning Ordinance no one younger than 19 may be a permanent resident of Sun City. Minors may visit, however, for no more than 90 days.

The texts of Sun City Deed restrictions (there are more than 50) vary from one unit to another, but the following statements generally apply to all properties:

As stated in most deed restrictions, Sun City Home Owners Association is not obligated to enforce these restrictions. Upon receipt of a written complaint from a member of HOA, however, the staff of HOA will work with violators in an attempt to resolve violations.

COMPLAINTS AND THEIR RESOLUTION

Complaints from residents about violations of the Fair Housing Amendments Act and Restricted Zoning Ordinance are turned over immediately to Maricopa County authorities for enforcement.
Complaints filed by HOA members about Sun City deed restrictions are frequently resolved through HOA staff procedures. HOA Information Officers examine all cases not settled through routine methods, and recommend legal action to the Board of Directors when appropriate.

Become familiar with your applicable deed restrictions, and make sure no one can file a complaint against you. Conversely, if you spot what you think is a recent violation, get the facts and report them to HOA at the telephone number below. Your identity will be protected.

In some instances an apparent violation is an approved variance. In others the cost of correcting an old violation can't be justified. But if you are willing to do your part in keeping Sun City the desirable community envisioned by those who originally wrote the deed restrictions, we'll do our part.
